Welcome to the terms and conditions applicable to our relationship.

UCM Canada, the owner of this website ucm.center and the owner and operator of UCM products and merchandise, is referred to herein as UCM.
UCM is therefore the seller and the customer is referred to as the buyer or consumer.

The UCM Teaching and Research Center is also a publishing and distribution house whose main purpose is research into emotional intelligence, symbolic language and the interpretation of dreams, signs and symbols, as well as the benefits of meditation and yoga.
UCM uses its skills and seriousness to serve its customers, in order to satisfy their expectations to the best of its ability. To do this, it is agreed to strictly observe the following usual commercial rules, which are hereby recognized as a preliminary agreement to any exchange.

Please read these conditions carefully before placing an order with UCM.

Article 1 – Purpose and general information

These general terms and conditions define the rights and obligations of both parties (seller and buyer), and apply without restriction or reservation to all sales of products offered through the online merchant site www.ucm.center. Validating an order implies full acceptance of these terms and conditions of sale. The consumer acknowledges that he/she has been fully informed of the fact that his/her agreement to the content of these general terms and conditions does not require the handwritten signature of this document, insofar as the customer wishes to order the products presented online. The consumer has the option of saving or editing these general terms and conditions, it being specified that the knowledge, consultation and conservation of this document are the sole responsibility of the consumer. The consumer is responsible for any telecommunication costs incurred when accessing the Internet and using the site, as well as any contact costs for any subsequent claims.

Article 2 – Product overview

The products offered for sale on the site are available while stocks last. The visuals, labelling and packaging of products may evolve and differ significantly from the display on the site, without interfering with the content of the product itself. In addition, the customer always has the possibility of obtaining further information by electronic mail (e-mail) to the following e-mail address: info@ucm.center. UCM reserves the right to withdraw, replace, modify or change without prior notice the products presented, or if necessary to propose new products, without however modifying the specifications of the products already ordered by the customers.

Article 3 – Product use

The choice and purchase of a product are the sole responsibility of the customer. UCM declines all responsibility for any improper use of the products offered.

In all cases, UCM cannot be held responsible for non-compliance with the regulations and legislation in force in the country of receipt. The seller's liability is systematically limited to the value of the product in question, at the date of sale, without any possibility of recourse against the brand or company producing the product.

In the exceptional case of a proven defect or fault in the goods, UCM undertakes to replace or reimburse the defective goods at their initial sale value, according to the customer's choice, to the exclusion of all other procedures.

 Article 4 – Entry into force

These terms and conditions come into force and apply without reservation on the date of validation of the order, as specified on the invoice sent to the purchaser, who undertakes to respect them in full.

Article 5 – Proof of transaction - Order taking - Archiving

If you wish to purchase one or more items listed on the website, you must select each product you wish to purchase and add it to the shopping cart. When you have selected all the items you wish to purchase, you can confirm the contents of your basket and place your order.

At this stage, you'll be redirected to a page summarizing the details of the products you've selected, their prices and delivery options (with the relevant delivery charges). You will then be asked to choose the delivery options and shipping and payment methods that suit you best.

The computerized registers, kept in the computer systems of the ucm.center merchant site under reasonable security conditions, will be considered as proof of communication, orders and payments between the parties. Purchase orders and invoices are archived on a reliable and durable medium and will be produced as proof.

Any order placed with UCM will be automatically confirmed by electronic mail (e-mail) including the details of the order as well as the method of payment.

Any validation of the cart including the price of the goods, the delivery charges and the method of payment on the website www.ucm.center is considered to be an order confirmation. In accordance with the provisions of the applicable regulations on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order after having viewed the details of your order and in particular its total price, and having had the opportunity to correct any errors.
Contracts concluded on our website (data relating to your order in accordance with the GCS in force on the day of your order) are archived for a period of 10 years. You can access archived contracts by sending a request by e-mail to info@ucm.center or by post to :

Article 6 – Prices and taxes

ZONE EURO/SWITZERLAND

Prices are indicated in Euro/CHF (all taxes included) and are valid only on the date of validation of the order by the consumer. They include VAT (Sales Tax) on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products. Switzerland is managed and administered by Association UCM Suisse and all member countries of the European Union and the rest of Europe by Association UCM France.

ZONE CANADA

Prices are indicated in Canadian dollars, all taxes included, and are valid only on the date the order is validated by the consumer, who mentions his order. Shipping and delivery costs are not included in product prices, except for special promotions for certain countries (Canada and Switzerland). VAT is not applicable for countries outside the European Community and Switzerland, except on the amount of shipping costs.

ZONE US AND WORLD

Prices are indicated in US dollars (USD) and are only valid on the date the order is validated by the consumer, mentioning his order. Shipping and delivery costs are not included in product prices. No tax is applicable to purchases made and delivered in countries outside the European Community, Switzerland and Canada, except on the amount of shipping costs, subject to the reservation indicated below.

Please note that deliveries to countries outside the European Union, Switzerland or Canada may also be subject to various charges, taxes, duties and obligations, including customs and import taxes applicable to the country concerned. These costs are borne exclusively by the purchaser. Payment in full must be made at the time the order is placed, and becomes due and payable by UCM as soon as the order is validated. The sums paid cannot be considered as deposits or advance payments. Confirmation of payment of the order by the customer implies that the latter agrees to pay the related delivery charges, if any, and as mentioned at the last stage of the order, as an integral part thereof. UCM reserves the right to change all or part of its prices without prior notice. All orders placed after the price change will be subject to the new prices.

Article 7 – Method of payment

To pay for his order, the consumer has a choice of the following methods of payment: Online payment by credit card.

In the case of payment by credit card, the customer will receive confirmation of receipt of payment by e-mail from the vendor.

The consumer guarantees that he/she has the necessary authorizations to use the method of payment chosen when confirming the order form. UCM reserves the right to suspend any order and any delivery in the event of refusal of authorization of payment or in the event of nonpayment; in particular the right to refuse to carry out a delivery or to honor an order emanating from a consumer who would not have regulated completely or partially a preceding order or with whom a litigation of payment would be in the course of administration.

In the event of non-payment, in particular because of the bank's refusal to honour the transaction or because of a stop payment made by the customer on the transaction, before or after the conclusion of the transaction, UCM may terminate the sale by operation of law without notice or delay and may, where appropriate, demand the return of the product at the customer's expense. Penalties of an amount equal to the legal interest rate increased by ten points are applicable by operation of law to amounts unpaid at the end of a period of ten days following the date of invoicing or upon notification of rejection of bank payment for any other means of payment.

Article 8 – Product availability

Product offers are subject to stock availability at our warehouses worldwide. For products out of stock, offers will be maintained subject to availability from UCM suppliers. In the event of exceptional and punctual unavailability of a product after an order has been placed, UCM will inform customers by e-mail or post as soon as possible. Customers may then request cancellation or exchange of the order.

In accordance with the regulations currently in force in the present contractual conditions, UCM may in this case supply a product of equivalent quality and price. UCM will then bear the shipping costs. Should UCM fail to make use of this option, the purchaser will be reimbursed without delay and at the latest within thirty days of payment of the sums paid, except in the case of special arrangements subject to the purchaser's agreement, such as the transformation of the amount of the order into a purchase voucher or to be applied to the next order.

Article 9 – Facturation

After validation of the order, a written confirmation will be issued and automatically transmitted by electronic mail (e-mail) to the purchaser, except in the case of payment by cheque. In all cases, the final, detailed invoice for the transaction will be enclosed in hard copy with the product(s) ordered, in the corresponding parcel.

Article 10 – Delivery

Parcels are delivered by La Poste, using the SoColissimo solution, or in Express mode with the Chronopost paying option, within the time limits set by these delivery methods. To this end, the customer undertakes to provide exact postal details to which he/she has access. UCM France cannot be held responsible for any problem of delivery, loss or deterioration due to an error of coordinates, or falling under the responsibility of the post office or any other postal or courier service. The UCM association cannot be held responsible for the delivery of parcels by the postal delivery agent, to a person other than the named addressee mentioned on the parcel.

In the event of return of merchandise by the post office or any other postal or courier service, due to failure by the customer to collect the merchandise within the allotted time, the cost of re-shipment shall be borne by the customer. Upon receipt of a shipment, the customer must check the good condition of the goods received and, if necessary, make the usual reservations with the postal delivery service. No claim will be taken into account after acceptance of the goods without prior reservation by the customer with the carrier.

UCM France is committed to minimizing delivery times between the time of order and delivery. In periods of high traffic on the site, this period should in no case exceed 30 days for metropolitan France, in which case the customer may cancel the order and UCM will proceed with a full refund.

Our shipments are made with the utmost care and attention, but in the event of goods not conforming to the order form and/or in the event of an error in the preparation of the parcel, UCM France undertakes, upon prior agreement, to take charge of the return of the goods concerned in their undamaged condition and, upon receipt, to send the appropriate goods corresponding to the customer's order.

For delivery to Switzerland, Europe, Canada, the United States and the rest of the world, the procedures remain the same, only the postal services vary according to the country. We select the best possible services, both in terms of speed and shipping costs, to give you the best possible experience, such as UPS, Canada Post and others.

Article 11 – Guarantees

Customers subject to the regulations of the European Union benefit from the legal guarantee of conformity under the conditions of the articles of the European Directive 1999/44 transposed in France, in article L.211-4 et seq. of the French Consumer Code, and the guarantee of hidden defects under the conditions of articles 1641 et seq. of the French Civil Code.

Within the framework of an after-sales service procedure (provided by UCM), any return of incomplete merchandise or merchandise not in its original packaging will not be accepted. Any return of the product under the aforementioned warranty must be approved in advance by UCM by electronic mail (e-mail). To this end, the purchaser should contact the after-sales department by letter or e-mail at: info@ucm.center. No returns will be accepted without UCM's prior authorization. In this case, the defective product must be returned in its original packaging, with all the product and accessories. All costs and risks associated with returning the product are to be borne by the customer. Products under warranty will be exchanged while stocks last. If the product is unavailable, UCM will automatically refund the product within 30 days of receipt of the defective product. In addition, the product must not have been used improperly, excessively or not in conformity with its intended use, and in general, the product must be in its original state of presentation. UCM reserves the right to determine in good faith whether all these conditions have been met. Subject to legal provisions, the seller's liability is strictly limited to the obligations defined in these conditions. In the event of bankruptcy or impossibility of supply by our suppliers, the purchaser shall have no recourse against the seller.

Article 12 – Withdrawal-Cancellation

In accordance with the regulations currently in force in the present conditions, the purchaser has a withdrawal period of 14 clear days from delivery of the order. Effects: Upon receipt of the return of the goods sent by the customer, if all the conditions of retraction are fulfilled by the latter, UCM will proceed with the full reimbursement of the order within 14 days at the latest. In any event, this refund will not incur any additional costs for you.

Exceptions to the right of withdrawal :

The right of withdrawal does not apply to:

  • The delivery of products that cannot be returned for reasons of hygiene or health protection, if you have unsealed them or if, after delivery, they have been inseparably mixed with other items.
  • The supply of products likely to deteriorate or expire rapidly.

Article 14 – Responsibilities

UCM shall not be held liable for non-performance of the contract in the event of unforeseeable unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood, fire.

Article 15 – Transfer of ownership

The transfer of ownership of the products to the purchaser will only take place after full payment of the price by the latter, regardless of the date of delivery of the said products, whereas the transfer of the risks of loss and deterioration of the products will take place upon receipt of the said products by the purchaser. These terms and conditions may be modified at any time without prior notice, in which case the modifications will apply to all subsequent orders.

Article 16 – Resolutory-penal clause

In the event of non-compliance with any of the consumer's obligations, the sale will be terminated ipso jure and the goods will be returned to the seller if he sees fit, without prejudice to any damages that the seller may claim against the buyer, within 48 hours of the formal notice remaining without effect. In this case, the seller is entitled to claim a fixed indemnity of 10% of the sale price from the buyer.

Article 17 – No waiver

The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions shall not be interpreted for the future as a waiver of the obligation in question.

Article 18 – Force majeure

Neither party will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. An act of God or force majeure shall be deemed to be any facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonable efforts. The party affected by such circumstances will notify the other within ten working days of becoming aware of them. The two parties will then meet within one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than three months, the present terms and conditions may be terminated by the injured party. The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by case law: blockage of means of transport or supply, earthquakes, fires, storms, floods, lightning; stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.

Article 19 – Divisibilité

If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

Article 20 – Jurisdiction and venue clause

The present contractual conditions are subject to French law for contracts concluded with a customer residing in France, or to the regulations of the member country of the European Union for a customer residing in one of these countries, and to the application of the Vienna Convention "on contracts for the international sale of goods" for a customer residing in a country other than the European Union.

In the event of a dispute arising in connection with a sale, as regards both its interpretation and its execution, and possibly after a search for an amicable solution:

For customers residing in France or in a country of the European Union, you, like us, agree to submit all disputes arising from the commercial relationship between you and us to the non-exclusive jurisdiction of the courts of France, which means that for the application of these Conditions of Sale, you may bring an action to enforce your rights as a consumer, in France or in the country of the European Union in which you reside.

For customers residing in other countries, you and we agree to submit all disputes arising from the commercial relationship between you and us to the exclusive jurisdiction of the courts of Montreal, Quebec, Canada.

Article 21 – Language

The languages used for the conclusion and the commitments of a contract are one of the followings:

  • English
  • German
  • Spanish
  • Italian

The language is chosen by the Customer by clicking on the Header tab in the top right-hand corner of the website at any time during navigation on the site, or when entering the site for the first time, by opting for the proposed choice, or before finalizing the order.

Article 22 – Election of domicile/residence

For the execution of the present contract, the parties elect domicile:
The seller at its registered office indicated in the legal notice;
The purchaser at the address provided in the billing address.

Article 23 – Information technology and freedom - Data protection

The information requested from the consumer when registering on the merchant site as a purchaser is necessary for the processing of the order and may be communicated to UCM's contractual partners involved in the execution of the order. When browsing our website www.ucm.center, you may be asked to provide us with personal data. We thank you for your trust and would like to inform you here about the use of your data and your rights.

VIII- Recording bank data

Your credit card details, such as type, name, number, expiry date and visual cryptogram (three-digit code on the back of the card), will not be stored for future use. When paying by credit card, if you wish to use this method of payment, this information is for one-time use only. You will need to repeat this process each time you place an order, as the data will not be stored, in order to preserve its confidentiality.

Our secure payment

We offer a secure payment system via Shopify, by credit card (Visa, Mastercard, AMEX, etc.): Shopify Payments.

No payment information is stored on our servers.

We cannot access or store any information about your secure payment, so it will have to be re-edited for each order.

Article 24 – Dream on demand

Welcome to the Dream on Demand service offered by the UCM Teaching and Research Center. Please read the following terms and conditions carefully before using our services.

Acceptance of terms: By using our Dream on Demand service, you acknowledge that you have read, understood and agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use this service.

Privacy Policy: We are committed to protecting and respecting your privacy. Your personal information, such as your name, e-mail address, physical address, etc., is collected solely for the purpose of analyzing and interpreting your dreams and will not be sold or shared with others. We have implemented the necessary security measures to protect your information. Personal data submitted to this site will be used only for the purposes specified in this privacy policy or in the relevant parts of the site.

Access to Certified Experts: Your information will be viewed only by Certified Dream Analysts who strictly adhere to our Privacy Policy. The intention of these certified professionals is solely to interpret dreams and provide a personalized, high-quality interpretation based on their years of experience and understanding.

Data security: We implement robust security measures to protect information from unauthorized access or alteration, disclosure or destruction. This includes internal reviews of our data collection, storage and processing practices, as well as security measures.

Use of Services: The Dream On Demand service offered by us is to be used for personal dream interpretation purposes only. Any misuse of the service or the information it provides will result in immediate termination of the service.

Updates and modifications to the conditions : UCM Teaching and Research Center reserves the right to modify these Terms and Conditions at any time without notice. Your continued use of the service following any such modifications constitutes your acceptance of the new terms.

Limitation of Liability: The UCM Teaching and Research Center shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from your use of, or inability to use, the UCM Teaching and Research Center services, including, but not limited to, your reliance on any information obtained through Dream on Demand.

By registering for the Rêve à la Demande service, you represent that you are of legal age to accept these Terms and Conditions, and you agree to be bound by them.

Article 25 – Article 25 – Interpretation of Dreams, Signs and Symbols (DSSI) training / 3 Months of Dreaming / DreamerOne

By enrolling (hereinafter "STUDENT") in one of the training courses (IRSS, 3MR, DreamerOne) of the UCM Teaching and Research Center (hereinafter "UCM"), I understand and agree that :

  • UCM undertakes to the best of its ability and competence to ensure and guarantee the confidentiality of dreams and information transmitted by the STUDENT.

  • UCM undertakes to protect the STUDENT's personal information. All data provided by the STUDENT, including submitted dreams, are confidential and will not be shared with third parties, except where required by law. UCM uses security measures to protect STUDENT data from unauthorized access, use or disclosure.

  • The provision of training by UCM is in no way a substitute for medical treatment and follow-up, which are the sole responsibility and decision of the STUDENT; regardless of the advice received in the course of training with UCM.

  • The STUDENT is free to apply or not to apply the advice received through his training given by UCM. A significant physical or psychological health problem on the part of the STUDENT may result in the permanent or temporary termination of his or her training, for the safety and well-being of the STUDENT, subject to UCM's discretion.

  • UCM declines all responsibility, on the one hand, for following or not following the recommendations made through its various teaching approaches, recommendations as well as for their content, but also, for the interpretations of dreams, which will be communicated and, on the other hand, for any possible bodily, psychological or illness damage which could result from the decisions and actions of the STUDENT.

  • UCM reserves the right to modify the terms and conditions of its Training Service at any time and without notice. The STUDENT is invited to consult this document regularly to take note of any modifications.

  • The training courses offered by UCM propose a deepening of the self through the learning of Symbolic Language®, a method developed by UCM and allowing the understanding of unconscious dynamics linked to thoughts, emotions and behaviors.

  • UCM training courses are a paying service. The STUDENT may make payment via the payment methods offered on the UCM website or via the recommendations provided by email to the STUDENT.

  • In the event of non-payment of a UCM course by the STUDENT: UCM undertakes a communication with the information provided by THE STUDENT, in order to clarify his situation. If there is no response from the STUDENT within 1 month to the day after the first correspondence clarifying the non-payment, the STUDENT's access to the training will be paused until payment is made in due form.

  • UCM offers a refund only in the event that the STUDENT, for important and duly communicated reasons, must stop a course before its completion. In this case, UCM will retain a 25% refund to cover the cost of managing the STUDENT's file and any courses he/she may have received beforehand.

  • All content and materials offered as part of UCM training courses, including dream analyses and associated advice, are the exclusive property of UCM and are protected by applicable intellectual property laws. UCM reserves the right without prior notice to use dream data ethically, confidentially and anonymously to improve its various services in the interpretation of dream signs and symbols. STUDENT may not reproduce, modify or distribute such content and materials without UCM's prior permission.
